RBC describes purchases made while a supermarket was at the land-and-permit or construction stage. In the transaction structure it describes, a 10% deposit was placed in notary escrow, with the bank controlling the funds.
The buyer paid the full contract price after construction and acceptance, and after a priority notice of conveyance (Erwerbsvormerkung) had been registered. RBC says the seller could receive the deposit if the buyer failed to pay after completion.
